The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

• Content refers to content such as text, images, game submissions, reviews, or other information that can be posted, uploaded, linked to or otherwise made available by You, regardless of the form of that content.
• Country refers to: United States
• Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
• Game means any indie video game submitted to or featured on our platform.
• Indie Game means a video game developed independently by individuals or small teams without major publisher support.
• Press Kit means marketing materials and game information hosted through our press kit service.
• Service refers to the Website and all related services provided by Indieop.
• Terms and Conditions (also referred as "Terms") mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
• User means any individual who accesses or uses the Service, including both gamers and developers.
• Vote means the act of ranking or endorsing a game through our daily voting system.
• Website refers to Indieop, accessible from https://indieop.com
• You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.

By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.

You represent that you are over the age of 13. Users under 18 must have parental consent to use the Service.

Description of Service

Indieop provides a platform for indie game discovery and community engagement, including:

• Daily ranking system for indie games
• Community voting mechanisms
• Press kit hosting and directory services
• Game key distribution system
• Developer and gamer community features

User Accounts

When You create an account with Us, You must provide Us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account on Our Service.

You are responsible for safeguarding the password that You use to access the Service and for any activities or actions under Your password.

You agree not to disclose Your password to any third party. You must notify Us immediately upon becoming aware of any breach of security or unauthorized use of Your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than You without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.

Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Submit false, misleading, or fraudulent information
• Engage in vote manipulation, spam, or fraud
• Submit AAA games or non-indie games to our indie-only platform
• Harass, abuse, threaten, or harm other users
• Attempt to gain unauthorized access to the Service or other users' accounts
• Upload malicious software or viruses
• Impersonate any person or entity
• Collect or harvest personal information from other users
• Use automated systems to interact with the Service without permission

Game Submissions and Content

Eligibility Requirements

When submitting games to Indieop:

• Games must be independently developed (indie games only)
• AAA games and major publisher-backed titles are explicitly prohibited
• You must own the rights to the submitted game or have explicit permission from the rights holder
• Game information must be accurate, complete, and up-to-date
• Games must comply with content guidelines and age rating requirements

Content License

By submitting Content to the Service, You grant Us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service for the purpose of operating and promoting our platform.

You retain ownership of Your Content, but You are responsible for ensuring You have the right to grant this license.

Content Restrictions

You may not submit Content that:

• Is unlawful, harmful, threatening, abusive, defamatory, or obscene
• Infringes on intellectual property rights
• Contains malicious code or viruses
• Promotes illegal activities
• Contains excessive violence, hate speech, or discriminatory content
• Violates platform content guidelines

Voting System

Our voting system operates under these principles:

• One vote per verified user per game per day
• Vote manipulation, bot voting, or fraudulent voting is strictly prohibited
• We reserve the right to invalidate suspicious votes
• Verified accounts only - account verification may be required
• Anti-manipulation measures are continuously enforced
• Violation of voting rules may result in account suspension or termination

Press Kit Services

Paid Services

Press kit hosting is a paid service offered at $5 per month. By subscribing to this service:

• You agree to provide accurate billing information
• Subscriptions automatically renew unless cancelled
• You may cancel at any time through Your account settings
• Refunds are provided according to our refund policy
• We reserve the right to modify pricing with 30 days' notice

Press Kit Content

You are responsible for the accuracy and appropriateness of all press kit content. Press kit materials must comply with our content guidelines and accurately represent Your game.

Prizes and Rewards

Regarding daily prizes and game keys:

• Prizes are awarded based on daily voting results
• We purchase keys for winning games to support developers
• Prize distribution is at our discretion and subject to availability
• Winners must provide valid contact information
• Unclaimed prizes may be forfeited after reasonable time
• No cash alternative for prizes
• We reserve the right to modify the prize structure
• Prize eligibility may require account verification

Payment Terms

For paid services:

• Payments are processed securely through third-party providers
• All fees are non-refundable except as required by law or stated in our refund policy
• You are responsible for any applicable taxes
• Failure to pay may result in service suspension
• Disputed charges must be reported within 60 days

Refund Policy

For press kit hosting services, refunds are available within 7 days of initial purchase. After 7 days, no refunds will be provided except as required by applicable law.

Intellectual Property

The Service and its original content, features, and functionality are owned by the Company and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

You retain ownership of Your submitted content, but You grant us necessary licenses to operate the Service as described in these Terms.

Privacy

Your privacy is important to Us. Please review Our Privacy Policy, which also governs Your use of the Service, to understand Our practices.

Termination

We may terminate or suspend Your Account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms.

Upon termination:

• Your right to use the Service will cease immediately
• We may delete Your account and Content
• Outstanding payments become immediately due
• Certain provisions of these Terms will survive termination

Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

We do not endorse any games, developers, or content on our platform. Users participate in voting and community features at their own discretion.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the Company be liable for any special, incidental, indirect, or consequential damages whatsoever arising out of or in connection with Your use of the Service.

Our total liability to You for all damages, losses, and causes of action shall not exceed the amount paid by You to us in the twelve (12) months preceding the claim.

Indemnification

You agree to defend, indemnify, and hold harmless the Company from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from Your use of the Service or violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Dispute Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law.

Changes to These Terms

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms.
